Terms and Conditions

These Terms of Service are a binding agreement between you and EverChapter, operated by Zero Day Technology LLC. By tapping "I Have Read and Agree," creating an account, signing in, or using EverChapter, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

Zero Day Technology LLC and its officers, directors, employees, agents, contractors, licensors, and affiliates (collectively, "Zero Day Technology") disclaim all liability and responsibility for any claims, damages, losses, costs, or liabilities arising from or related to your use of EverChapter. You use this app entirely at your own risk.

1. Eligibility and authority

You must be at least 13 years old to use EverChapter on your own. If you are under the age of majority where you live, your parent or legal guardian must review and agree to these Terms for you. If you are a parent or guardian allowing a minor to use EverChapter, you are responsible for that minor's activity and for making sure the minor follows these Terms.

EverChapter is not intended to knowingly collect personal information from children under 13 without legally valid parental consent. If you believe a child under 13 has provided personal information without consent, contact us so we can review and delete the information where required by law.

2. What EverChapter provides

EverChapter is a reading companion app that may include book tracking, reading goals, quests, rewards, virtual items, social or friend features, notifications, premium features, and account sync. EverChapter is for personal, non-commercial entertainment and organization. It is not an educational institution, professional reading assessment, medical service, mental health service, legal service, or financial service.

Zero Day Technology LLC makes no representations, warranties, or guarantees about the accuracy, reliability, completeness, quality, suitability, or timeliness of any content, features, or services provided through EverChapter. Zero Day Technology LLC is not responsible for any decisions you make based on information or features in the app, including but not limited to book selections, reading goals, time management, or social interactions.

3. Accounts and sign-in

You are responsible for the accuracy of information connected to your account and for all activity that occurs through your account. You must not share, sell, transfer, or misuse account access. You agree to notify us if you believe your account has been accessed without permission. We may suspend, restrict, or terminate access if we reasonably believe your account has been misused, violates these Terms, creates risk, or is required by law or platform rules.

4. User content and book information

You may add book titles, notes, quotes, reading progress, profile details, friend information, and other content. You represent that you have the rights needed to submit that content and that it does not violate law or anyone else's rights. Do not submit content that is unlawful, abusive, harassing, threatening, defamatory, hateful, sexually explicit, exploitative, invasive of privacy, infringing, misleading, or harmful.

You keep ownership of your content. You give EverChapter a worldwide, non-exclusive, royalty-free license to host, store, process, display, transmit, back up, and use your content only as needed to operate, secure, improve, and provide the app and related services. We may remove content or restrict features if content violates these Terms or creates legal, safety, or operational risk.

5. Acceptable use

You agree not to reverse engineer, scrape, overload, disrupt, attack, copy, resell, or exploit EverChapter or its systems. You agree not to use the app to spam, impersonate others, collect information about others without permission, upload malicious code, bypass security, manipulate rewards or purchases, interfere with other users, or violate applicable law.

6. Friends, sharing, and community features

If EverChapter includes friend codes, activity sharing, profiles, avatars, or similar features, you are responsible for what you share. Do not share private information, sensitive personal information, or content you do not want others to see. We may limit, remove, or moderate social features to protect users, comply with law, or maintain the service.

7. Purchases, subscriptions, and virtual items

Premium features, subscriptions, virtual items, coins, decorations, or other paid features may be offered. Purchases are processed by Apple or another payment provider and may be subject to that provider's terms. Unless required by law or platform policy, purchases are final and non-refundable. Virtual items have no cash value, are licensed rather than sold, and may be changed, removed, or discontinued as part of normal app updates.

Zero Day Technology LLC is not responsible for any issues with purchases, billing, payment processing, refunds, unauthorized charges, or problems with virtual items. All payment disputes must be directed to the applicable payment provider (such as Apple). Zero Day Technology LLC makes no guarantees regarding the continued availability of any paid features, subscriptions, or virtual items.

8. Privacy and data

Your use of EverChapter is also governed by our Privacy Policy. The app may process account identifiers, reading progress, saved books, notes, friend data, device information, purchase status, notifications, diagnostics, and related app data to provide and improve the service. You are responsible for not entering sensitive personal information into notes, quotes, names, or other optional fields.

ZERO DAY TECHNOLOGY LLC IS NOT RESPONSIBLE FOR ANY SECURITY BREACHES, DATA LOSS, UNAUTHORIZED ACCESS, OR PRIVACY VIOLATIONS THAT MAY OCCUR. While Zero Day Technology LLC implements reasonable security measures, no system is completely secure, and Zero Day Technology LLC cannot and does not guarantee the security of your data or account. You acknowledge and accept all risks associated with transmitting and storing information electronically. Zero Day Technology LLC is not liable for any harm resulting from data breaches, hacking, unauthorized access, interception of communications, or disclosure of your information, whether by third parties or due to technical failures.

9. Notifications

If you enable notifications, EverChapter may send reminders, quest updates, friend activity, reward messages, or account-related notices. You can control notification permissions in your device settings. Zero Day Technology LLC is not responsible or liable for missed, delayed, blocked, inaccurate, inappropriate, or undelivered notifications, or for any consequences resulting from notifications or the lack thereof. You acknowledge that notifications are provided as a convenience and that Zero Day Technology LLC makes no guarantees regarding notification delivery or timing.

10. Third-party services and content

EverChapter may rely on third-party services such as Firebase, Google Sign-In, Apple Sign-In, book search providers, StoreKit, analytics, cloud storage, or external links. Zero Day Technology LLC does not control, endorse, verify, or take responsibility for any third-party services, content, products, advertisements, websites, or actions. Your use of third-party services may be governed by their own terms and privacy policies. Zero Day Technology LLC expressly disclaims all liability for any harm, loss, damages, or issues arising from third-party services, including but not limited to service interruptions, data breaches, inaccurate information, unavailable content, or unauthorized charges. You access and use all third-party services entirely at your own risk.

11. App changes and availability

Zero Day Technology LLC may update, modify, suspend, discontinue, limit, or remove any part of EverChapter at any time without notice or liability. Zero Day Technology LLC does not guarantee that the app will always be available, uninterrupted, secure, error-free, compatible with every device, or free from data loss, bugs, or technical problems. You are responsible for keeping your device, operating system, and app version up to date. Zero Day Technology LLC is not liable for any damages, losses, or harm resulting from service interruptions, app updates, discontinued features, compatibility issues, data loss, or unavailability of the app for any reason.

12. No warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, EVERCHAPTER IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. ZERO DAY TECHNOLOGY LLC EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, UNINTERRUPTED OPERATION, ERROR-FREE PERFORMANCE, COMPATIBILITY, QUALITY, COMPLETENESS, AND TIMELINESS. ZERO DAY TECHNOLOGY LLC MAKES NO WARRANTY THAT THE APP WILL MEET YOUR REQUIREMENTS, THAT IT WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED, OR THAT THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE APP IS AT YOUR SOLE RISK.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ZERO DAY TECHNOLOGY LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AFFILIATES, SERVICE PROVIDERS, SUPPLIERS, AND PARTNERS (COLLECTIVELY, "RELEASED PARTIES") WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR LOST-PROFIT DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, LOSS OF GOODWILL, LOSS OF USE, BUSINESS INTERRUPTION, SERVICE INTERRUPTION, PERSONAL INJURY, EMOTIONAL DISTRESS, PRIVACY VIOLATIONS, DEVICE DAMAGE OR MALFUNCTION, SYSTEM CORRUPTION, UNAUTHORIZED ACCESS, SECURITY BREACHES, HACKING, IDENTITY THEFT, FRAUD, THIRD-PARTY CONDUCT, CONTENT ERRORS, MISSED NOTIFICATIONS, FAILED BACKUPS, CORRUPTION OF DATA, INCOMPATIBILITY ISSUES, OR ANY OTHER HARM ARISING FROM OR RELATED TO YOUR USE OR INABILITY TO USE EVERCHAPTER, EVEN IF ZERO DAY TECHNOLOGY LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, ZERO DAY TECHNOLOGY LLC'S TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS RELATED TO EVERCHAPTER, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ZERO DAY TECHNOLOGY LLC FOR THE APP OR SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) 100 US DOLLARS.

ZERO DAY TECHNOLOGY LLC IS NOT RESPONSIBLE OR LIABLE FOR: (1) ANY ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES; (2) ANY HARM RESULTING FROM YOUR VOLUNTARY DISCLOSURE OF PERSONAL INFORMATION; (3) ANY TECHNICAL FAILURES, BUGS, ERRORS, DOWNTIME, OR PERFORMANCE ISSUES; (4) ANY LOSS OR DAMAGE TO YOUR CONTENT OR DATA; (5) ANY DECISIONS, ACTIONS, OR CONSEQUENCES RESULTING FROM YOUR USE OF THE APP; (6) ANY RELIANCE YOU PLACE ON CONTENT OR FEATURES IN THE APP; (7) ANY UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR DATA; (8) ANY INTERRUPTION OR CESSATION OF SERVICE; OR (9) ANY OTHER MATTER RELATING TO EVERCHAPTER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURisdictions, ZERO DAY TECHNOLOGY LLC'S LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW. YOU ACKNOWLEDGE THAT THE DISCLAIMERS AND LIMITATIONS IN THESE TERMS REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK BETWEEN YOU AND ZERO DAY TECHNOLOGY LLC AND ARE FUNDAMENTAL ELEMENTS OF THE BARGAIN BETWEEN YOU AND ZERO DAY TECHNOLOGY LLC. ZERO DAY TECHNOLOGY LLC WOULD NOT BE ABLE TO PROVIDE EVERCHAPTER TO YOU WITHOUT THESE LIMITATIONS.

14. Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Zero Day Technology LLC and all Released Parties from and against any and all claims, demands, actions, suits, proceedings, damages, losses, liabilities, settlements, costs, and expenses, including reasonable attorneys' fees and court costs, arising from or related to: (a) your content; (b) your use or misuse of the app; (c) your violation of these Terms; (d) your violation of any applicable law, regulation, or third-party right; (e) your violation of another person's rights, including intellectual property rights or privacy rights; (f) any content or information you submit, post, transmit, or make available through the app; (g) your willful misconduct or negligence; or (h) any dispute between you and another user. This indemnification obligation will survive termination of these Terms and your use of EverChapter.

15. Termination

You may stop using EverChapter at any time. Zero Day Technology LLC may suspend or terminate your access immediately, with or without cause, with or without notice, if you violate these Terms, create risk, misuse the service, or if continued access is unlawful or commercially impractical. Zero Day Technology LLC is not liable for any damages, losses, or consequences resulting from suspension or termination of your access. Upon termination, your right to use the app ceases immediately. Sections that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, indemnity, and dispute terms.

16. Disputes

Before filing a formal claim, you agree to contact us and try to resolve the dispute informally for at least 30 days. To the fullest extent permitted by law, disputes must be brought individually and not as a class, collective, consolidated, or representative action. You and EverChapter waive the right to participate in a class action to the fullest extent permitted by law.

17. Governing law

These Terms are governed by the laws of the United States and the state where Zero Day Technology LLC is registered, without regard to conflict-of-law rules, except where consumer protection law requires otherwise. Any legal action or proceeding relating to your access to or use of EverChapter must be instituted in a court of competent jurisdiction in the location where Zero Day Technology LLC is registered. You agree to submit to the jurisdiction of such courts.

18. Changes to these Terms

Zero Day Technology LLC may update, modify, or replace these Terms at any time in its sole discretion. If changes are material, Zero Day Technology LLC may ask you to agree again or provide notice in the app. Your continued use of EverChapter after updated Terms become effective constitutes your acceptance of the updated Terms. Zero Day Technology LLC is not liable for any consequences resulting from changes to these Terms. It is your responsibility to review these Terms periodically.

19. Contact and notices

For questions, legal notices, privacy requests, support inquiries, or child privacy concerns, contact Zero Day Technology LLC at contact@zero-day-technology.com or through the support contact provided in the app listing or official support page. All notices to you may be provided via email, in-app notification, or by posting to the app. Zero Day Technology LLC is not responsible for any failure to receive notices due to spam filters, email settings, notification settings, or other technical issues.

20. General provisions

These Terms constitute the entire agreement between you and Zero Day Technology LLC regarding EverChapter and supersede all prior agreements and understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Zero Day Technology LLC's failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision. You may not assign or transfer these Terms or your rights under them without Zero Day Technology LLC's prior written consent. Zero Day Technology LLC may assign these Terms without restriction. There are no third-party beneficiaries to these Terms.

BY USING EVERCHAPTER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE, INCLUDING ALL DISCLAIMERS AND LIMITATIONS OF LIABILITY. YOU ACKNOWLEDGE THAT ZERO DAY TECHNOLOGY LLC HAS MADE NO WARRANTIES OR REPRESENTATIONS ABOUT EVERCHAPTER AND THAT YOUR USE IS ENTIRELY AT YOUR OWN RISK.
